Our services include identifying potential customers for your business, creating and running targeted advertising campaigns, and delivering qualified leads that have responded to these campaigns.

1.2 Pricing Model

Our pricing is based on a per-qualified-lead model, with rates varying depending on the advertising channel used. A "qualified lead" is defined as a potential customer who has responded to our advertising campaigns and expressed interest in learning more about your products or services.

2. User Responsibilities

By using our services, you agree to:

  • Provide accurate and complete information about your business and products/services
  • Respond to leads in a timely and professional manner
  • Comply with all applicable laws and regulations, including those related to marketing, advertising, and data privacy
  • Not use our services for any illegal or unauthorized purpose
  • Not infringe upon the intellectual property rights of others

3. Payment Terms

Payment for our services is based on the number of qualified leads delivered. Invoices will be issued on a monthly basis and are due within 30 days of receipt. We reserve the right to suspend services for accounts with outstanding balances.

4. Lead Quality and Verification

We verify all leads before delivery to ensure they meet our quality standards. If you believe a lead does not meet these standards, you must notify us within 7 days of receiving the lead. We will review the lead and, if we determine it does not meet our standards, we will provide a credit for that lead on your next invoice.

5. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of DataAria and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of DataAria.

6. Limitation of Liability

In no event shall DataAria, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content

7. Indemnification

You agree to defend, indemnify, and hold harmless DataAria and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:

  • Your use and access of the Service
  • Your violation of any term of these Terms
  • Your violation of any third-party right, including without limitation any copyright, property, or privacy right
  • Any claim that your content caused damage to a third party

8. Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
